End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legally binding agreement between you (referred to as "User", “You” or "Your") and Metamory Technology Limited ("Metamory”, "We”, "Our” or "Us") governing the use of the mobile application "Petamory" (the "App"). By using the App, you acknowledge that you have read this Agreement, that you understand it, and that you accept and agree to be bound by the terms and conditions set out in this Agreement. If you do not understand the Agreement, or do not accept any part of it, then you may not use the App.
1. Grant of License
Metamory Technology Limited grants You a limited, non-exclusive, non-transferable license to download, install, and use the App on your mobile device for personal, non-commercial purposes. This license is subject to your compliance with the terms and conditions of this Agreement.
2. Intellectual Property
All intellectual property rights, including but not limited to copyrights and trademarks, associated with the App and its content, are owned by Metamory and are protected by law. You shall not modify, copy, distribute, reverse engineer, or attempt to derive the source code of the App.
3. User Obligations
3.1 You shall comply with all applicable laws and regulations while using the App.
3.2 You shall not engage in any unauthorized activities, including but not limited to hacking, unauthorized access, or interfering with the App's functionality.
3.3 You shall respect the rights of other users and refrain from posting or sharing any content that is defamatory, offensive, or infringing.
4. Privacy and Data Collection
Metamory Technology Limited collects and processes personal data in accordance with its Privacy Policy, which can be accessed [HERE]. By using the App, You consent to the collection, use, and storage of Your personal data as outlined in the Privacy Policy.
5. User-Generated Content
5.1 You are solely responsible for any content, including photos, text, or comments, that You upload or share through the App.
5.2 Metamory reserves the right to monitor and remove any inappropriate or infringing content posted by Users.
6. Limitations of Liability
6.1 Metamory shall not be liable for any damages or losses incurred by you while using the App, including but not limited to technical issues, errors, or interruptions in service.
6.2 You acknowledge and agree that you download and use the App at your own risk.
7. Termination
Metamory reserves the right to terminate or suspend your access to the App, in whole or in part, in the event of a violation of this Agreement or if We determine that your use of the App poses a risk to other users or the integrity of the App.
8. Applicable Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
9. Updates and Modifications
Metamory reserves the right to update or modify this Agreement at any time. We will provide notice of any material changes through the App. Your continued use of the App after such changes constitutes acceptance of the revised Agreement.

11. Third-Party Agreement Terms
You must comply with applicable third-party agreement terms when using the Licensed Application.
12. Third-Party Beneficiary
You acknowledge and agree that the iOS Download Platform and its subsidiaries are third-party beneficiaries of this EULA. Upon Your acceptance of this EULA, the Download Platform will have the right to enforce this EULA against You as a third-party beneficiary.
13. Legal Compliance
You represent and warrant that You are not located in a country subject to any Government embargo or designated as a "terrorist supporting" country. You further represent that You are not listed on any Government list of prohibited or restricted parties.
14. Product and Service
Petamory provides 3D modeling and 3D modeling printing based on the pictures and videos you have provided. You can purchase this value-added service in-app. The price of service and product will change at any time due to uncertainty or unpredictability. The pictures and videos you have provided will only be used in creating 3D models, Petamory will not forward any information or data to others.
15. Petamory reserves the right to add, subtract and change the EULA at any time.
